Understanding clinical negligence

Clinical negligence, also referred to as medical negligence, is where a doctor or other health care professional has made a mistake and failed in his or her duty to a patient. Whilst most people do not have a problem and the healthcare provided by the NHS (or privately) is very good, mistakes are made, and things do go wrong.

Some examples of clinical negligence are:

  • Failure to diagnose/delay in diagnosis/misdiagnosis
  • Surgical/operating error
  • Failure to obtain consent
  • Failure to warn about the risks of a surgical procedure
  • Dental negligence
  • GP error
  • Dispensing error
  • Inadequate follow-up care after treatment
  • Failure to recognise/treat symptoms
  • Failure to undertake proper testing
