Back on track: Thomas' road to recovery after a devastating motorcycle collision

How Minster Law secured rehabilitation, private treatment and a settlement to help Thomas move forward after a life-changing road traffic collision.

The accident
In February 2023, Thomas was riding his motorcycle home from work on the Isle of Wight when his life changed in an instant.

As he approached a junction, a car turned across his path, causing a collision which left him with devastating injuries. Thomas sustained an open fracture of his right tibia and fibula requiring emergency surgery, with metalwork inserted to stabilise his leg. Although the initial operation was successful, his recovery proved anything but straightforward.

Over the following three years, Thomas endured repeated setbacks. His fracture failed to heal correctly, leading to a painful non-union which ultimately required complex reconstructive surgery, removal of the original metalwork and application of an external Illizarov frame. During his recovery he experienced repeated infections, further surgery, prolonged rehabilitation and uncertainty over whether he would ever regain full function.

How Minster Law supported Thomas

Recognising that Thomas required more than legal representation alone, Minster Law secured early rehabilitation under the Rehabilitation Code. A dedicated Case Manager was appointed to coordinate his recovery, ensuring that he received timely access to the treatment and support he needed.

As Thomas’ recovery became increasingly complex, we secured significant funding to enable him to undergo specialist private orthopaedic treatment. This included major reconstructive surgery to his right leg, involving the removal of existing metalwork, further treatment of the non-union and the application of an external Illizarov frame. The surgery and subsequent treatment were substantial and intrusive, requiring many months of recovery and further procedures. By securing private funding for this treatment, Thomas was able to access the specialist surgery he needed without the delay he may otherwise have faced, accelerating his treatment pathway and ultimately helping him to move forward with his recovery and get his life back on track.

Throughout the claim, interim payments were obtained to ease the financial pressures caused by Thomas’ inability to return to his pre-accident employment. These payments helped replace lost income and provided financial stability whilst he focused on his recovery.

The accident affected every aspect of Thomas’ life. Before the collision, he was an active nurse and care home manager who enjoyed gardening, DIY, motorcycling and spending time outdoors with his daughter. Following the accident, he became reliant upon family and his partner for many everyday activities, including cooking, shopping, personal care and caring for his daughter, who has additional needs.

To ensure every aspect of Thomas’ claim was properly evidenced, Minster Law obtained reports from leading medical experts across a number of disciplines. This comprehensive medical evidence allowed us to accurately value both his current losses and his future needs.

Following detailed negotiations, we successfully secured a settlement in excess of £350,000. By the time settlement was reached Thomas had made significant progress in his recovery, providing greater certainty about his future than had existed during some of the most difficult stages of his case. The settlement reflected Thomas’ improved position whilst properly compensating him for the serious injuries, financial losses and considerable disruption the accident had caused to his life.

The difference between the position Thomas found himself in following the collision and where he is today is significant. After years dominated by surgery, an external frame, restricted mobility and uncertainty about whether his leg would heal, Thomas has been able to start rebuilding his independence and looking towards the future.

The specialist treatment and rehabilitation secured during the claim have enabled Thomas to make substantial progress with his mobility and day-to-day independence. He has been able to move away from the level of reliance upon his family that characterised the earlier stages of his recovery and to begin returning to a more normal family life, spending time with his daughter and getting back to the things that mattered to him before the collision. Importantly, he has also been able to look again towards employment.

There remain aspects of Thomas’ recovery that he continues to manage, and the accident has undoubtedly changed his life. The settlement provides Thomas with financial security as he continues that process. Significantly, it has also enabled him to purchase a home for himself and his family, giving them a degree of stability and security that had been missing during the three years following the accident. After such a prolonged and uncertain recovery, Thomas can now look beyond the litigation and concentrate on the next chapter of his life
