Am I entitled to make a claim for compensation?

To ensure that we at Minster Law are able to pursue a personal injury claim on your behalf, you need to be able to answer yes to the following questions:

  • Were you injured within the last 3 years in England or Wales?
  • Was someone else at fault for your injury?
  • Is this your first attempt to try and claim?
  • Do you have details of the other party involved?
  • Were you, your dependants or passengers injured?

Can I make a personal injury claim on behalf of someone else?

If the accident has resulted in an injury to a dependant child, then you are able to bring a claim for personal injury on their behalf. The child may still be obliged to attend a medical examination.

For fatal accidents/injuries, dependants of the deceased (defined as dependent children, a spouse or common law spouse, or other dependants who had a relationship with the deceased) may make a claim.

Outside of this, for cases such as an elderly relative, you may request a call back or call us on 0800 030 4012 on behalf of the injured party. However, the injured person may still be required to attend a medical examination, make a statement and, in the rare situations where a case proceeds to court, they may also be required to attend the court hearing. Any compensation will be awarded to the party who has suffered the injury.
