Accidents Abroad

If you’ve had an accident whilst on holiday abroad, on a cruise ship, or even in-flight, you may still be able to claim compensation in the UK.

Regulations

Different legislation applies in the UK depending on where your accident occurred, and on what type of transport, but the main ones are:

  • Package Travel, Package Holidays and Package Tour Regulations 1992 – can cover your airport transfers, and accidents within your accommodation or whilst on a pre-booked excursion
  • Montreal Convention – covers accidents during your flight, or whilst embarking/disembarking from the aircraft
  • Athens Convention – covers accidents on cruise ships or ferries
  • European Motor Protocols – covers road accidents within Europe

Examples of Accidents Abroad

Here’s a few examples of the types of claim we may be able to deal with:

  • Swimming pool accidents
  • Accidents on a pre-booked excursion
  • Slips/trips
  • Food poisoning
  • Car accidents in Europe
  • Injuries occurring in-flight

Eligibility

There are just a few requirements (depending on the type of claim) we would need to enable us to consider your claim:

  • If the accident occurred within your accommodation abroad, or during the airport transfer, that you pre-booked at least two of the following together: flights, transfers, accommodation
  • That you reported your accident (for example – if on the plane – to the cabin crew; if in your hotel – to the manager or your holiday rep)
  • That you sought some sort of medical attention
  • If your accident was on the plane or on a ship/ferry, you only have two years to submit a claim (rather than the usual three)

It would also be desirable to have:

  • Photos of the defect that caused your accident
  • Details of any witnesses to your accident
  • In the case of a road accident in some European countries you’ll need a copy of the police report or accident report.
