Need A Will?

Talking, thinking and planning for death is naturally uncomfortable for any one. Chances are that if you’re reading this then you are one of those 75% of who do not have a Will. At Minster Law it’s all about giving you, the client, the full picture so it’s important to us that you know where you stand.

If you die without a Will (known as dying intestate) the intestacy rules dictate who inherits what.

In brief those living in England & Wales (only) who are married or in a civil partnership, with children, would only see their partner getting the first £250,000 of their estate plus a life interest in half the remainder, your children would inherit what’s left. The rules for those in Scotland and Northern Ireland are different.

So where do you stand?

The bottom line is without a Will you’re not in control, so:

  • If you’re married your spouse may not inherit what you expect
  • If you’re cohabiting with your partner then they receive nothing
  • If you have children there is the chance the courts, not you, will decide who looks after them
  • Your wishes with regards to your pets, your funeral arrangements and more may not be adhered to
    • We are sure you will agree that in any event leaving the law to decide as to what happens to your estate is not the way forward. The solution is simple – do a Will.
