Probate Terms & Conditions
- 1. Fixed Fees apply to ‘excepted’ estates which fall below the current Inheritance Tax threshold for an individual or for a married couple or registered civil partners where a successful application is made to carry forward any unused nil rate band of the spouse/ civil partner who died first.
- 2. Our fixed fee price covers probate/letters of administration where there is one property and savings accounts. We charge additional fees for complex estates where there are; shares, bonds, a significant number of accounts, pensions, multiple properties, issues with proving the Will, contentious estates, Deeds of Variation, tax planning or where the deceased was not domiciled in England & Wales. All fees shall be agreed with you in advance of carrying out the work.
- 3. The fixed legal fee is subject to VAT at the current rate (as at 1st January 2010 this stands at 17.5%).
- 4. Professional fees in respect of valuing, marketing or disposing of estate assets are not included in the fixed fee and will be treated as disbursements payable by the estate.
- 5. Fees and disbursements in respect of the preparation of Home Information Packs for the sale of any property are not included in the fixed fee.
- 6. The fixed fee excludes legal fees and disbursements in respect of the sale of any estate property, our conveyancing service offers competitive fixed fees.
- 7. Disbursements are not included in the fixed fee, typically disbursements in a probate matter will be £40.00 for the court fee and £1.00 per copy of the Grant of Representation.
- 8. We are required to verify the identity of our clients. We will carry out these checks electronically and the cost of £10.00 each plus VAT will be treated as an additional legal charge and is not included in the fixed fee.
- 9. A partial administration includes assessing the value of the estate based on information provided by you in relation to the assets and liabilities of the estate, completion of the Inheritance Tax return, preparation of the executor’s oath and submission of the probate application to the District Probate Registry. You will collect in and liquidate the assets of the estate, discharge all liabilities of the estate and distribute the estate to the beneficiaries.
